These Terms & Conditions ("Terms") are a contract between you and Albus, Inc. ("Albus", "we", "us"). They cover your use of the Albus mobile apps, the web client at albus.games, and everything we offer through them (the "Service"). Please read them carefully — by signing up or using Albus, you agree to them.
You need to be old enough to use Albus. Coins are non-refundable except where required by law. Don't harass people, cheat, or stream content you don't own. We can suspend accounts that break the rules. Disputes go through arbitration unless you opt out within 30 days.
The agreement
These Terms, together with our Privacy Policy, Cookie Policy, and Community Guidelines, form the entire agreement between you and Albus. They replace any prior agreements between us about the Service.
If you're using Albus on behalf of a company or organization, you represent that you have authority to bind it to these Terms.
Your account
To use most features of Albus you need an account. You agree to provide accurate information, keep your password secure, and not share your account with anyone else. You're responsible for everything that happens on your account.
You can close your account at any time from Settings, or by contacting Support. We may close, restrict, or merge accounts that are inactive for extended periods, that duplicate other accounts, or that we believe to be fraudulent.
Eligibility & age
You must be at least 13 years old to use Albus, or older where local law requires (16 in parts of the EEA, for example). Some features — including Coin purchases, gifting, and live streaming — may be limited or restricted to users 18+ depending on your region and applicable law.
If you're under 18, you must have permission from a parent or legal guardian to use the Service.
License to use Albus
Subject to your compliance with these Terms, Albus grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial enjoyment. You don't get any other rights — we keep ownership of everything else.
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from any part of Albus, except as expressly allowed by law.
- Use bots, scrapers, automated tools, or modified clients to interact with the Service.
- Resell, sublicense, or rent any part of the Service.
- Bypass technical protections, rate limits, regional restrictions, or moderation systems.
Coins, Artifacts & gifts
Coins are a virtual, in-app currency you can buy and use inside Albus. Artifacts are virtual items (skins, boosts, consumables) you can buy with Coins and use across compatible games, or gift to other users during streams.
The following terms apply to Coins, Artifacts, and any other virtual items:
- They have no real-world cash value and cannot be exchanged for money outside Albus.
- They are licensed, not sold. You don't own them — you have a personal, non-transferable license to use them within the Service.
- They are non-transferable outside the gifting features we provide.
- We may modify, expire, or discontinue specific Coin bundles, Artifacts, or features at any time. We'll provide reasonable notice for material changes.
- If your account is suspended or terminated for violating these Terms, any unused Coins or Artifacts may be forfeited.
Payments & refunds
Coin purchases on mobile go through Apple's App Store or Google Play under their billing rules. Web purchases (where available) are processed by Stripe. The price displayed at checkout is the price you pay, including any applicable taxes.
Refunds. Coin and Artifact purchases are generally final and non-refundable, except where required by your local consumer-protection law. For mobile purchases, refund requests must usually go through Apple or Google directly. For web purchases handled by Stripe, contact Support within 14 days of purchase.
If we issue a refund, the corresponding Coins and any Artifacts purchased with them will be removed from your account.
Streaming & user content
Albus lets you broadcast gameplay, send chat messages, and gift Artifacts. Anything you stream, type, post, or upload is "User Content."
You keep ownership of your User Content. By submitting it, you grant Albus a worldwide, royalty-free, non-exclusive license to host, store, transmit, transcode, record (as VODs), display, and distribute it as needed to operate the Service. This license ends when you remove the content or close your account, except for copies we keep for backup, legal, or moderation reasons.
You promise that:
- You own or have the rights to all the User Content you submit (including any music, art, voice, or imagery).
- Your User Content doesn't violate anyone else's rights or any law.
- Your stream is accurate about you (no impersonation).
VOD recordings are retained for up to 48 hours, then deleted (except where we must keep them longer for moderation or legal reasons).
Acceptable use
While using Albus, you agree not to:
- Harass, threaten, or harm other users.
- Post or stream sexual content involving minors, real-world violence, illegal activity, or content that infringes others' intellectual property.
- Cheat in games (including using exploits, bots, or modified clients) or interfere with multiplayer fairness.
- Spam, phish, scam, or use Albus to distribute malware.
- Use gifting to launder money, manipulate metrics, or artificially boost streamers.
- Misrepresent your age or identity, or evade a suspension by creating new accounts.
Our full Community Guidelines have more detail and examples. Violations can lead to content removal, feature restrictions, suspension, or permanent ban.
Intellectual property
Albus, the Albus name, logo, mascot, original games ("Albus Originals"), Artifact designs, and the look and feel of the Service are owned by Albus, Inc. and protected by copyright, trademark, and other laws. Nothing in these Terms gives you any right to use them outside the Service.
Copyright complaints. If you believe content on Albus infringes your copyright, send a notice that meets the DMCA requirements (or your local equivalent) to dmca@albus.games. Repeat infringers will have their accounts terminated.
Third-party services
Albus integrates with services we don't run, including Apple, Google, Stripe, social login providers, and the operators of any third-party games featured on the platform. Your use of those services is also governed by their own terms and privacy policies. We're not responsible for them.
Suspension & termination
We may suspend or terminate your account if you breach these Terms, our Community Guidelines, or any applicable law, or if we're required to do so by law. We'll generally tell you why, unless doing so would compromise an investigation or pose a safety risk.
You can terminate this agreement at any time by closing your account. The following sections survive termination: Coins (forfeiture rules), Intellectual property, Disclaimers, Limitation of liability, Disputes, and Contact.
Disclaimers
Albus is provided "as is" and "as available." We don't warrant that the Service will be uninterrupted, error-free, secure, or that any specific game, Artifact, or feature will be available at any particular time. To the maximum extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent allowed by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost goodwill arising out of or relating to these Terms or the Service.
Albus's total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid Albus in the 12 months before the claim, or (b) USD $100.
Some jurisdictions don't allow these limits, so they may not apply to you. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or anything else that can't be limited by law.
Disputes & governing law
These Terms are governed by the laws of the State of [Delaware], without regard to conflict-of-laws principles, except where local consumer law gives you stronger protections.
Informal resolution. Before filing a formal claim, you agree to contact us at legal@albus.games and try to resolve it for at least 60 days.
Arbitration. If we can't resolve it informally, you and Albus agree to resolve disputes by binding individual arbitration under the rules of [JAMS / AAA], not in court, and not as part of a class action. You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@albus.games with the subject line "Arbitration Opt-Out."
Nothing here prevents either of us from seeking injunctive relief in court for intellectual property infringement, or from bringing a small-claims action where eligible.
Changes to these Terms
We may update these Terms from time to time. If the changes are material, we'll notify you in-app and by email at least 14 days before they take effect. By continuing to use Albus after the effective date, you accept the new Terms.
